TERMS OF SERVICE: NEURASYNA AI

1. ACCEPTANCE OF TERMS

By accessing or using Neurasyna AI (the “Platform”), you agree to be bound by these Terms of Service. If you do not agree, you may not use the Platform. These terms constitute a legally binding agreement between you and Andrei Sandulescu.

2. ELIGIBILITY & AGE VERIFICATION

• Minimum Age: You must be at least 18 years of age to use this Platform.
• Verification: Neurasyna AI employs AI-based age verification (selfie-analysis). By using the service, you consent to the processing of biometric data for the sole purpose of age verification. This data is processed instantly and is not stored beyond the verification session.

3. NATURE OF SERVICE & MEDICAL DISCLAIMER

• Not Therapy: Neurasyna AI provides AI-facilitated tools for self-reflection and coaching support. It is NOT a medical device, a licensed mental health service, or a crisis intervention tool.
• No Professional Advice: The "Healers," "Coaches," and "Experts" are AI personas, not licensed professionals. Responses are AI-generated.
• Crisis Warning: If you are experiencing a mental health emergency or suicidal thoughts, do not use this platform. Contact local emergency services or a crisis hotline immediately.
• Accuracy: All responses include the notice: "Note: This response is AI-generated. Please verify facts against trusted sources before use." The Provider is not liable for any decisions made based on AI-generated content.

4. THERAPIST’S AI ASSISTANT & PROFESSIONAL RESPONSIBILITY

• User Responsibility: If you are a therapist, you are the Data Controller regarding your clients' information.
• Informed Consent: You warrant that you have obtained explicit, informed consent from your clients before uploading any session transcripts or data.
• Indemnification: You agree to indemnify the Provider against any legal claims arising from your failure to obtain proper client consent.

5. PAYMENTS, CREDITS, AND REFUNDS

• Free Credits: New users receive 250 free credits for testing purposes.
• Prepaid Model: Additional credits are purchased on an on-demand, prepaid basis.
• Expiration: Credits expire 12 months from the date of purchase.
• Pricing: The Provider reserves the right to adjust prices based on market fluctuations. Existing credits are unaffected by future price changes.
• Refund Policy: All purchases are generally non-refundable. Exceptions are made only in cases of verified technical failure where credits were deducted without service delivery.

6. DATA PRIVACY AND SECURITY

• Hosting: Data is hosted on a VPS in Germany, compliant with EU data residency.
• Encryption: All data is encrypted using AES-256 and transmitted via HTTPS.
• AI Training: Neurasyna AI does not use your personal conversations or transcripts to train its AI models.
• Moderation: A moderation layer filters for hate speech and PII disclosure. Flagged messages are declined and not stored.
• Compliance: We strive for GDPR and HIPAA-level security standards, including periodic penetration testing.

7. INTELLECTUAL PROPERTY

• User Input: You retain full ownership and copyright of any journals or transcripts you input.
• AI Output: You own the copyright to specific AI-generated outputs (biographies, evaluations) created based on your inputs.
• Platform IP: The Neurasyna AI name, logo, and algorithms remain the exclusive property of Andrei Sandulescu.

8. PROHIBITED CONDUCT

You agree not to:

• Attempt to "jailbreak," reverse engineer, or scrape the Platform.
• Generate hate speech, harassment, or promote illegal activities.
• Abuse the free credit system by creating multiple accounts.
• Violation of these rules will result in an immediate and permanent ban without a refund.

9. ACCOUNT DELETION & TERMINATION

• User Deletion: If you delete your account, all associated data is permanently deleted from our active database.
• Reactivation: Deleted accounts cannot be self-reactivated (to prevent credit abuse). Contact support for manual review.
• Provider Rights: The Provider reserves the right to terminate access for any user exhibiting abusive behavior.

10. LIMITATION OF LIABILITY

To the maximum extent permitted by law, Andrei Sandulescu shall not be liable for any indirect, incidental, or consequential damages (including emotional distress or loss of data). The service is provided "AS IS."

11. GOVERNING LAW

These Terms are governed by the laws of the European Union and the national laws of Romania. Any disputes shall be resolved in the competent courts of the Provider's jurisdiction.
